1. Acceptance of Terms
By downloading or using the I'm Well application ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
I'm Well is a wellness check-in application for personal use. It enables users ("Checkers") to perform daily check-ins and notify designated family members or caregivers ("Subscribers") if a check-in is missed.
3. Not a Medical or Emergency Service
I'm Well is not a medical device, emergency response service, or substitute for professional care. It does not replace calling emergency services (911 or local equivalent). In any genuine emergency, call emergency services immediately. I'm Well makes no guarantee of notification delivery speed or reliability in life-threatening situations.
4. User Accounts
You are responsible for maintaining the security of your account credentials and for all activity under your account. You must provide accurate information when registering. You must be at least 13 years old to use the Service.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to reverse-engineer, decompile, or interfere with the Service.
- Use the Service to harass, monitor, or track individuals without their consent.
- Generate excessive check-in events or otherwise abuse the escalation system.
6. Subscription and Billing
The Free tier is available at no cost. Plus and Family subscriptions are billed monthly through the App Store (Apple) or Google Play. Pricing is subject to change with 30 days' notice. You may cancel at any time through your app store account; no refunds are given for partial billing periods.
7. Disclaimer of Warranties
The Service is provided "as is" without warranty of any kind. We do not guarantee uninterrupted availability, and we are not liable for missed notifications due to network outages, device issues, or third-party service failures (including carrier SMS delivery).
8. Limitation of Liability
To the maximum extent permitted by law, I'm Well's liability for any claim arising from the Service is limited to the amount you paid in the twelve months preceding the claim, or $10 USD, whichever is greater.
9. Changes to Terms
We may update these Terms. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
10. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.
